can i get work comp after the two year statute is up

i work as an auditor with a waist hanging keyboard and was diagnosed with tendonitis march 2001, i have been receiving cortisone shots since but now they no longer work and have no right arm use at all. this was a repetitive stress syndrome injury but i was only interested in getting the shot every three months (in elbow) and returning to work.my own health insurance has paid for all this and i really did not miss massive amounts of work so i really did not think of it as workers comp, however now i find another employee with the same injury has filed and is receiving work comp. am i out of luck?

You may possible be in luck, depending on when you knew this was a work related accident, and the last date you performed the work that caused the repetitive stress injury. The statute normally tolls from the date you learn or should have reasonably known that the problems you are experiencing were caused by the repetitive stress at work. There are a number of legal factors involved in this analysis. You should immediately, if not sooner, contact a qualified workers' compensation attorney to pursue this matter.
