Legal Question in Workers Comp in Florida

worker compensation question

I was hurt at work over a year ago, had surgery on my spine. Doctor has not released me,after one year from surgery . My question is right now I'm receiving my by-weekly checks, can I receive a lump check before the two year limit is reached. I may not be able to go back to work for a long , long time if ever again.

You can settle your case for a lump sum at any time before or after the 104 weeks. The two year limit is only a limitation on temporary disability benefits, not permanent total disability benefits, and certainly not medical benefits. when you consider a lump sum settlement you must look at the future lost wage exposure as well as the value of the future medical care.
