Legal Question in Workers Comp in Florida
Workers Comp benefits
What benefits are you entitlted to after an injury on the job, and is the company responsible for paying for lost time on the job even if you go back to work after the injury? Do you get paid for the time spent at docotr visits or therapy? Or does the company have an option not to pay you for that time?

Re: Workers Comp benefits
If you are out of work for more than 1 week you begin to get compensation at 2/3 of your average weekly wages. If you are out of work more than 3 weeks, the compensation for the first week will then be paid. If you return to work at the same wages as before your injury you get no compensation for lost time but when you are finished with medical care, you will get some compensation for permanent injury if your doctor gives you a permanent impairment rating. As for time you lose for doctor visits and theray, you should be paid at your regular rate but the employer can get away with paying minimum wage. If you are still under treatment and your wages after the injury, after adding in the pay for time spent going to the doctor and therapy, are less than 80% of what you earned before the injury, you get addtional compensation to make up part of the loss. All compensation benefits are not taxed. If this sounds confusing, it is. Contact a workers' compensation lawyer for a consultation.
