Legal Question in Workers Comp in Florida

Worker's Comp and Pay in Florida

My husband fell off a ladder at work and is presently on light duty. He is now being paid is hourly wage by his employer but is not making the overtime pay he was prior to the accident. Is the worker's comp. company required to pay him any monies towards the money he is now not making in overtime?

Re: Worker's Comp and Pay in Florida

The answer is maybe. Compensation is based on a "13 week wage" which is calculated using the 13 weeks of income prior to the accident.

I suggest that you ask the adjuster on the claim for clarification of his wage and see if he qualifies for additional indemnity payments. This is the fastest and easiest way to handle it.

You can also contact a Worker's Compensation attorney for assistance in evaluating whether you have a claim.
