Legal Question in Workers Comp in Florida

workers com[

I'm lost!! Worker Comp case from 1998 still haunting me via ins. carrier's attny. To do a washout, he wants personnel information that I feel is privileged, i.e., medical bills for routine health care which I have paid, my current employer, my cirrent wages, my education, etc. This claim was over & I've seen the MD as prescribed (2x yr). The carrier's attny has gone so far as to ''state in writing'' that I cannot receive any care (invasive/shots/etc. @ present. I was awarded lifetime coverage by the judge & believe that includes any/all medical care til death unless I sign/agree to a ''washout'' which I have not done!! My own attny has heard my concerns & continues to evade my questions. When I make an appt, it gets ''cancelle'' via voice mail/msg(s). In spite of 5 months attempts to talk with my attny, I have not done so. I feel am not being represented professionally & am ready to file for an investigation in respect to the treatment I've rec'd. What should I do about lack of attny contact, paperwork I feel is beyond the normal/resonable requirements/requests? I'd prefer not to go out & hire another attny, as I'm too stressed out to start this case over. Your advise is greatly requested.

I don't know who your lawyer is, but I am sure it's not me. That being said, write to your lawyer. Send the letter by certified mail. Give him or her one more opportunity to set an appointment to meet with you to discuss your case. If that fails, consider getting a new lawyer and/or filing a complaint with the Bar. When you hired your lawyer you were (or should have been) given a statement of clients rights to sign and keep a copy. You have the right to be kept informed about your case and to discuss the work the lawyer is doing for you.

Good luck.
