Legal Question in Workers Comp in Florida

Worker's Rights at the job

I recently have been diagnosed with a herniated disc in my neck and need to start going to pain management and a chiropractor. My work basically said that they can't work with me for my appointments. They know that they can not fire me because of my condition. So, they just took me off of full-time status to part-time status until they find someone to take over my position full-time. Then, when they find someone, they are going to demote me to mailings. So, I want to know if I have a case and should I just quit??? They also took my medical benefits from me and want to put me on COBRA.Is this fair?

Re: Worker's Rights at the job

In general, an Employer is not allowed to terminate an employee as a result of a workers' compensation injury, although it happens all the time under the disguise of another reason. In your situation, it appears that you need a consultation from an attorney who handles labor and employment law as opposed to workers' compensation.

Good luck
