Legal Question in Family Law in France

Who gets custody according to French law?

I am a German national and my partner is French. We live in the UK. Our daughter is born in the UK but has the French nationality.

If I was to seperate from my partner, according to French law, who would gain custody and what are the conditions?

Re: Who gets custody according to French law?

You would most likely both get joint custody, the real question being with whom the child resides. The basic test is the best interest of the child. This is a subjective decision and turns on a variety of facts, only some of which I can mention here - age of the child, gender of the child, who is best able to care for the child, existence or not of siblings, where each parent lives, etc. It's too complex an issue to give you a cut and dried answer.
