Legal Question in Family Law in France

divorce in france

If two people, not of French nationality, are living in France but have been separated for over two years, could one of them file for divorce, and how long would it take? If he filed on grounds of adultery, what would this entail?

Re: divorce in france

The first question is what is the petitioning party's status regarding residence in the state of Indiana and county in which the action is sought to be filed. Has it been maintained and how.

Indiana is a "no fault divorce" jurisdiction. This means that the only reson that is given is that there has been an irretrivable break down of the marriage. Specific grounds are not required.

If this is not a contested matter, the time frame could be 120 to 180 days at best. Keep in mind that if property and debt were aquired in the marriage or if there are childern, these issues will need to be addressed. This may result in a longer time span then otherwise indicated.
