Legal Question in Family Law in France

French-US Divorce

How long does it take for a divorce to be pronounced final in France with one person of French nationality and the other of American nationality, each living in his respective country? Must divorce proceedings be filed in both countries? Does each party need a lawyer?

Re: French-US Divorce

If both parties consent to the divorce it is possible under Fr law to use only one lawyer. It is not necessary to file 2 divorce proceedings. The delay turns upon the type of divorce and where in France it is filed. Delays vary from court to court. Seven to nine months is probably a minimum delay. I generally advise using two lawyers. The choice of country is important. Are there minor children? Does the couple own real property and, if so, where is it located? Divorce of international couples can be complex, and there are quite a few traps for the unwary.
