Legal Question in Family Law in France

seperation/divorce split assets

Hi..My wife and I are separating. She has said it is not reconcilable at any point in future. We currently have two houses (one in france, one in US). The house in france doesnt have much equity and I am looking after it. it is rented and they pay the mortgage. The house in france does not have a mortgage and is under renovation (early stage). I want to stay here, but I dont want my wife to try and obtain half of the houses value when complete. Is this where I need a date of seperation to fix the value now. She also wants to take the children back to the UK (the kids are us citizens). I also pay for all bills here in france. She will go for divorce eventually. Do I need her to state anything on paper?

Thank you

Re: seperation/divorce split assets

This is a complex question. Where were you married? What is your matrimonial regime? In whose name is the French house? Was it purchased before or after the marriage? If after, who put up the money? Does the deed reflect who put up the funds? Who has been financing the renovation? Are there invoices and proof of payment? Simply signing a document will not resolve the issue under French law. There are not enough facts to be able to advise. If you want, you can phone me at 04-42-92-08-20, and I shall try to give you a preliminary response at no charge.
