the courts have awarded me administrator's rights over my son's estate, he died in a car accident and have two small kids. He was single but I need to know to file a law suit for personal injury/wrongful death and worker's compensation claim. what are the attorney fees?

The attorneys fees are between you as administrator and the attorney you hire, so you first need to meet with some qualified lawyers in your area (or the area in which your son lived and the accident occurred). If you know lawyers in the area, ask them for recommendations. Also keep in mind that like anything else, you often get what you pay for. Price shopping for a lower contingency fee might turn out to be a very poor decision if the lawyer is not qualified.

Cases like this are usually taken on a percentage (termed a "contingent fee") of the recovery with no attorney fees owed by the client unless the attorney wins the case or obtains a settlement accepted by the client. Workers compensation attorneys fees are 25% of the recovery (this is set by statute). Attorney fees in a wrongful death case arising out of an automobile collision are usually 33 1/3% of the recovery. This is not set by statute but has developed over time as the usual and customary fee. Typically this is not a bargaining point with the better lawyers. I would be wary of an attorney who offered to charge a lower percentage. The lawyer should include any work done on the estate necessary to go forward with the wrongful death case as part of his services covered by the percentage fee. Alternatively, you could hire an attorney on an hourly rate which most people find cost prohibitive and for which payment would have to be made to the attorney regardless of the outcome of the case.
