Legal Question in Personal Injury in Georgia
I suffered a head injury at Subway.I was getting my drink when the top of the coke fountain fell off onto my head.I didnt fall but definitely saw stars. They all stood staring not offering any help.I heard them say as they were picking up the piece of metal that it was supposed to be bolted down.I went directly to doctor .I was diagnosed with concussion and had a CT scan. What do I need to do legally?

If your medical bills are at least a few thousand dollars, get a lawyer.
The very first thing be certain to get the right medical care first. You need to make sure to be checked over thoroughly. Head injuries can be very serious and not necessarily show up immediately. You should follow up with a neurologist or neurosurgeon and do it more than 1 time. I would suggest 3 months, 6 months and 1 year. If you have a clean bill of health then you should be safe. I have represented many head injured people and it is not as simple as most folks think. If you have any symptoms of head injury at any of those doctor visits I suggest you have the neurologist or neurosurgeon refer you for testing by a neuropsychologist. That is a subspeciality within the field of psychology that tests for motor skill degradation caused by head injury. They can even determine the area of the brain damaged based upon the testing results. That said, you probably do not have permanent damage from this incident. I am just telling you that f it was my head, I would want to do the foregoing. There is a 2 year statute of limitations for filing suit for personal injury in Georgia. If you come out of this with a clean bill of health you claim is a small one. If you do have a head injury problem that can be documented the case would be worth , depending on the severity, many thousands of dollars (perhaps hundreds of thousands) and needs to be handled by a lawyer experienced in head injury cases. Most attorneys will not know what to do and will screw things up so be sure to get an attorney who knows about this kind of case. Either way I think you need representation.

I agree you should be sure to get proper follow upedical care, but also be sure to advise the subway store manager IN WRITING to PRESERVE ANY SURVEILLANCE VIDEO, PREPARE AN INCIDENT REPORT AND PRESERVE ALL EVIDENCE OF THE UNBOLTED DRINK FOUNTAIN, as you may need this later to pursue this claim, and you must put them on notice in order to preserve this evidence.
