My son is a musician andplays out of the Atlanta area. His drummer was hauling my son's equipment when both the truck and equipment was stolen. **** also owned the truck that he was hauling my son's equipment in. **** has refused to accept any responsibility for my son's equipment. Also, although the truck was locked, they keys were left in the truck, which is a negligent act on **** part. Do we have a claim that we can make against **** in small claims court?

Does your son live with you? If so, he may be able to make a claim under your homeowner's policy. Likewise if your son lives separately from you but has a homeowner's policy of his own. The truck policy may also provide coverage without having to prove liability on the part of Josh. I would think it would be wise to exhaust all options before filing litigation and probably costing a friendship permanently, win or lose.
