Magistrate Court Appeals
A judgment for past due rent was granted to Plaintiffs against Defendant in Magistrate Court. Subsequently Defendant filed an appeal in Superior Court. Defendant did not request a hearing date but only served Notice of Appeal on Plaintiffs. How long does Defendant have before either the case is dismissed or put on the docket if a court date is not requested .

That is up to the court. And, most likely, the appeal will not be dismissed unless the defendant withdraws it.
