Whether you are arrested is up to the bank filing a commplaint with the police or DA. That seems unlikely, especially since they made the first mistake and they probably just want the money. However, should they take action like filing a civil complain, the "I thought the money was mine" excuse will likely not get very far. Most people should, and do, know what is happening with their bank account and most likely you would have seen the error no later than the next statement. You are apparently trying to force them to give you an interest free loan for money you should have never spent, and money you should immediately pay back.
