How to get a name of a banking account

My daughter will be 21 the end of this month. Her grandmother gave her $5,000 a year ago, to be used when she graduates (she will be a senior in college next year), but she never saw the money, or the check. It was sent to her father in Florida, who supposedly opened an account in his name, without my daughter's name on it. She has asked him for statements so she could see how much of HER money was there. He refuses. It has come to our attention that he has taken money out of that account for his own purposes to pay HIS portion of the college fees. Is there anything my daughter can do to get his name legally taken off the accounts? She's an adult, but he's treating her like a juvenile.

The issue is the money, not the name on the bank account. You do not state who the check was made out to, which is obviously important. Did he signed her name, or was it made out to him? If made out to him, and he paid her expenses with the money, the issue seems less clear. However, the bottom line is that SHE (since you point out she is an adult) will have to decide how far to push it. Getting a lawyer and theatening legal action against dad, whether or not justified, often harms family relationships for years. Perhaps grandma can step in to help resolve it.
