Legal Question in Banking Law in Georgia
I have a business checking account with SUNTRUST in georgia, one customer placed a large order while paying by depositing a check into my account, the check has cleared already in my account ( 5 bus days), if i want to use the money now, how can i be protected from being held liable later on in case that check is found not good, or used fraudulently? i wouldn't like to go to jail or having to return the money back, after having the goods shipped out.
How can i be protected, what can I do, to save my responsibility in case something goes wrong later on,few weeks later after having spent the money...this is driving me crazy..

The fact that this is bothering you so much means that your business needs a no check policy. When a business owner can't sleep at night, he needs to make his decisions accordingly. Especially since bad check notices are mailed, and the postal service is slow these days, five days is NOT long enough to wait. After a couple of weeks check your account online, and while you are not 100% sure even then, you're fairly safe.
Again, in the future, don't take checks.
