Can a Credit Card Issuser charge me $39.00 becuse their annuall service fee, which I knew nothing about, took me over my limit by $1.00?

Yes.
(And you need to read the card agreement that you received with your card (and every bill insert that changes terms) as those DID disclose the fee to you. You need to read every insert in every bill and with every renewal and new card.
Yes. What you did or did not know is not relevant. What is relevant is whether they properly disclosed the fee in the paperwork that came with the card (or in a separate mailing), or the online terms and conditions, or subsequent amendments. If you did not read and understand the terms, it is your fault. You did not provide that information, but most people who review the materials prior to writing the question mention that they did that.
