Legal Question in Banking Law in Georgia
Money was taken out of my checking and savings account via ATM, but I do not remember taking it out.(I had been drinking) I want to file a bank fraud but If it turns out it was me can the state file a lawsuit against me? The Bank has already agreed not to do so we find out that it was in fact myself who withdrew the money.

If your drinking problem is so bad that you cannot recall ATM visits, you need alcohol rehab. That is not normal and your life could be in danger. Get yourself scheduled for an inpatient stay.
You may want to file a carefully worded written statement asking the bank to check out the withdrawals and tell them that because of your chronic alcoholism that you do not recall if they are yours and want them to investigate. Do NOT call it "bank fraud."
At the same time, cut up your ATM card until your drinking problem has been resolved.
