Legal Question in Bankruptcy in Georgia
I need some advise on if it would be in my best intersest to file for bankruptcy. First some background- 58 year old male, divorced, disabled ( receiving Social Security Disability payments $1,664.00 per month), $ 42,000.00 debt ( credit cards, line-of credit), Mortgage payment on house ( $1,137.00 ) Have basically exhausted all my savings, Roth IRA, etc. No real assets of any value left other than my 2003 Mazda truck. Is there a possibility that I could file for bankruptcy proptection and still keep my house ( atleast until the housing market improves) so I can sell it. That is my major goal !!!!

You need to see a BR lawyer in your area - no doubt many will offer a free call or meeting. This is not a decision to make based on the info you provided. The lawyer will know what questions to ask you.
More information regarding your home is needed before an answer can be given. You may contact me at [email protected] if you wish.
The key question as to keeping the house is usually the amount of equity and whether the mortgage payments are current. I'd need more details. Feel free to call me at 404.768.3509 in your are in metro Atlanta or North Georgia as I handle bankruptcy cases in those areas.
