i am writing for my mom who has no computer. She lives in Georgia and her husband is filing for bankruptcy (chapter 7). They have been married for 8 years and own no joint property. She owns her home she had before they were married and has good credit and a solid carreer. they have no bills, debts, property,or anything in a joint name. He claims his attorney needs her financial info as well. Yet ,when my mom has requested to speak with her about this matter she has not called back. The husband claims he cannot file without my mom's financial info as well????? why is this needed?

Re: why would attorney need info on spouse for bankruptcy when there are no join
When a married individual files for Chapter 7 the bankruptcy trustee needs to know the financial information of the entire household. Because a married couple operates as one economic unit, the spouse who is not filing must include her income on the petition. If between the two incomes there is enough to pay the bills the bankruptcy trustee may deny the Chapter 7.
