Legal Question in Bankruptcy in Georgia

Authorized User in Bankrutcy

If I file for Chpt 7 bankruptcy and my husband does not, will his credit be affected if I am listed as an authorized user on a few of his cards? They are not joint accounts, only include me as an authorized signer. Should he contact the companies in question and have me removed from his accounts? Also does the bankruptcy have and affect on our joint bank account and debit cards? We do not have over $500 in bank accounts at any given time. We live pay check to pay check. I am a partner in a failed business and cannot pay the business debt I personally guaranteed. We do not have equity in the house.

Re: Authorized User in Bankrutcy

The affect on his creditor reports and accounts should be minimal, though his report might show the accounts were included in a bankruptcy case of someone else. He can dispute any negative reports. Removing you now won't change the past, but it might prevent the creditors from closing his accounts (on whatever basis they deem appropriate). Questions about your assets, such as checking accounts, etc., should be addressed to your BR lawyer.

Re: Authorized User in Bankruptcy

In general, authorized users will be unaffected, but I need a lot of specific financial information to assess all the pros and cons of a filing. It is VERY oimportant that you do not change an ything account-wise until you see an attorney as you may inadvertantly prevent yuourself from filing or make a situation worse with changes in accounts. If you're in metro Atlanta, get a free worksheet on my website and I'll be glad to review your case with you.
