Bankruptcy and child support

My ex-husband is filing for bankruptcy in Georgia. I received a ''Notice of Chapter 7 Bankruptcy Case, Meeting of Creditors and Deadlines'' from the bankruptcy court today. It appears he is trying to get his child support obligation discharged. Is this possible? I have never heard of this happening before. He stopped paying child support in July of this year.

True child support obligatins are not dischargeable, and the new laws provide more protection for the spouse receiving the support. You need to get a lawyer to keep up with the BR case, and seek a contempt order in state court if necessary.

Child support is not dischargeable. The new bankruptcy code requires that you be notified. What effects the case has on you cannot be determined fully without seeing the complete case file, but the non-dischareability rule is likely to help you. You should have a lawyer review your case at this point.
