Legal Question in Bankruptcy in Georgia

Bankruptcy

My father filed bankruptcy in my name (to protect the house he was living in that was in my name) without my knowledge or permission and the court accepted the filing without proper identification. I found out when my credit card company sent me a letter notifying me of my reduced line of credit. What are my options to remove this bankruptcy from my credit?

Re: Bankruptcy

The problem does not start with your credit report. It starts with a fraudulent filing. That means you start with getting a lawyer to take the appropriate steps with the Bankruptcy Court to void the filing. You have years of problems if you don't and creditors certainly are not going to take your word over court documents, when you don't take the steps to correct the court records.

Re: Bankruptcy

What you are saying is virtually impossible as he would have had to have produced your dfrivers license and social security card at a hearing.

However, if what you claim is true, it is a felony. Start by seeing the U.S. Attorney in your district who can put him in jail. Be aware that if this happened that he likely will serve jail time and that if you have lied about it you can too. Additionally, you should retain counsel to get the bankruptcy case reopened and voided, and will then have to also deal with your credit report after that.
