Legal Question in Bankruptcy in Georgia
bankruptcy after levys
I recently made a fi.fa. collection based on a debt owed to me. Recieved $2000 in cash and a car and another item. If he files bankruptcy now, after I've taken his stuff, does he get it back? Including the cash? Doesn't he have a 6 month counseling session to partake in before filing bankruptcy? Thanks for your help.

Yes, a trustee could request that you return the property, depending on the specific facts. The counseling session takes about an hour.

It is very possible that monies you got would be taken back by the Bankruptcy Court.
The prefiling counseling can be completed in an hour or two.
