Legal Question in Bankruptcy in Georgia

Is Chapter 7 my best option?

My husband & I purchased a house 6 mos. ago. We have about $13,000 in equity. During our application process I noticed that there was a judgement on my credit report. I called the creditor & worked a deal to repay & they sent me a letter agreeing to the repayment terms @ a greatly reduced amount. I never heard from them again & with the move I forgot about them too. The other day I received a letter from my bank stating that there was a garnishment on my account for an enormous amont of money from this creditor.

I would like to get rid of this debt as well as some medical & other misc. debts that total about $30,000. My hubby does not wish to file though I think we should file joint. Is Chap.7 my best option to get rid of my debt, keep my house and re-establish myself?

Also, I have the primary income (& its not much) as my husband has gone through a series of layoffs over the past 3 years or so. Would we/I be a good candidate for Chap.7? I filed a Chap.13 in 1997 and dismissed it a year later on some bad advice from an attorney ''wannabe''. I tried to re-file immediatley after I dismissed and it was denied. I cannot afford a garnishment as I have the only real income outside of my husband's $222 weekly unemployment.

Re: Is Chapter 7 my best option?

A Chapter 7 might work. The recent purchase of the home is a concern unless there has been some major change since then in finances.

There is no way to answer "what if's" without a lot of information. We have a free worksheet at http://www.glenashman.com (in 2 parts) that you can download and complete. Once completed I could review it for you.
