Legal Question in Bankruptcy in Georgia
Commissioned sales pay
I estimate, bid and manage flooring jobs for a company that appears to be very close to filing bankruptcy. I am owed about $12,000.00 in commissions. What is my legal right to claim. What is their legal means of paying or not paying

Re: Commissioned sales pay
If a company files bankruptcy, you may or may not be paid, depending on the case. In most cases you'll have no remedy, but with $12,000 at stake, you should IMMEDIATELY see a lawyer.

Re: Commissioned sales pay
If they file and have money for creditors, some employee claims have priority over other creditors for pre-petition wages. If they ultimately have no money available for unsecured creditors, priority is meaningless.
