Legal Question in Bankruptcy in Georgia

Continued bad debt/charge off entries

I and my wife filed bankruptcy chapter 7 nearly seven yrs ago. We have since paid most off voluntarily, and have re-estblished credit with major creditors. However there is one creditor that without fail, every 6 months, enters my original charged off debt as a new entry. I feel this is purely punitive and want to know is there anything I can do to stop it?

Creditor keeps reporting discharged debt

What you have may be bankruptcy contempt - check with the lawyer who handled your bankruptcy.

What you definitely have is a violation of the Fair Credit Reporting Act in Title 15United States Code Section 1692K (I believe). You can sue the creditor in Federal Court, get statutory damages and atorney fees.

Go get 'em!
