Legal Question in Bankruptcy in Georgia

converting from 13 to 7

I filed chpt 13 roughly 4 months ago. I have trouble making my monthly payments and would like to convert to chapter 7. I have moved counties and was wondering if it is possible to convert in my new county or do I have to go back to the county I originally filed to convert there or is there a possiblity to do it on my own?

In order to assist you with your question, I would need some additional information about your chapter 13 case. Feel free to contact me at [email protected]

Re: converting from 13 to 7

I assume you have a lawyer in your Chapter 13 and you probably just agreed to pay him $1500 to $2500, which is still coming out of your plan payment. You should call him to assist you, and it would add considerabl.y to your expense to call in a second lawyer, who could not assist you unless you discharged the first lawyer (whom you'd still have to pay).

It would add an expense to try and transfer a case, so the simplest answer is to do the conversion where the original case is.
