Legal Question in Bankruptcy in Georgia

do it yourself

Due to an accident my husband has become diassabled and we will need to file chapter 7. We cannot afford an attorney at this time. The house has gone into forclosure for Sept 7, It is for sale and we have a contract at this time.

Question is, is it difficult to file bankruptcy on your own and what happens if the house sells before filing?

Re: do it yourself

It can be a disaster to file bankruptcy yourself. Don't even think of it!

The legal fees to file can be very low at $290 (call me for details), so there is no reason to try and save and do it yourself, especially with real estate involved.

If you file, the foreclosure is delayed. You CANNOT sell the house once the case is filed without court approval, so do not market your house if you are thinking of bankruptcy without first talking to a bankruptcy lawyer. There are ways to market and possibly net you cash before or during a bankruptcy, depending on your circumstances.
