Legal Question in Bankruptcy in Georgia

Can I file for bankrupcy protection ? I am currently receiving only Social Security Disability payments. No other real assets now other than my 2003 truck which is paid off. I am current on mortgage payments and there is equity in home, but monthly payments on unsecured debt and other expenses are now more than I can financially handle. Need fresh start !!! Please advise.

Thank You

Almost anyone can file for bankruptcy. A lot of factors determine which type of bankruptcy would work for you. The two types of bankruptcy for individuals are Chapter 13 and Chapter 7. A Chapter 13 is a repayment plan, where debtors pay anywhere from 0% to 100% to their creditors. A Chapter 7 bankruptcy is a liquidation where the Trustee wants to sell off unexempt assets to pay off the debt. I would be more than happy to look at your specific situation and see what type of bankruptcy would work for you. Please feel free to call my office and schedule an appointment 678-990-4197.
