Legal Question in Bankruptcy in Georgia
Can someone file bankruptcy just to not pay you
I loaned a friend money thru a credit card of mine ,they have written bad checks and have quit paying on the loan the loan is not even 15mos.old of a 41 mo.loan.Am i stuck with this .I will be going to court but they say they are going to file bankruptcy,this loan was to consolidate bills anyway.Can someone file bankruptcy just to not pay you

The whole purpose of filing bankruptcy is to not pay creditors. Bear in mind that saying one has filed is not the same as filing, so you are free to try and collect unless they do. If they do, you need to stop unless the automatic stay is lifted.
