Legal Question in Bankruptcy in Georgia
House and Reaffirm
I am in the process of filing ch 7 bankruptcy. we just bought a house that appraised for 133,000 our loan is 126,000. how do i do the exemption? also, i am not including it in the bk, do i reaffirm it? how do i do that? i also have a car loan and furniture loan not included in the bk. do i have to list those items in the bk papers? do i do reaffirm them? i do not want any of these items (house, car & furniture) taken. i am attempting to do this before 10/17. with new laws, do i have to turn in whole packet before then or just the intent to file?

The bankruptcy code requires that you list all of your debts and all of your assets.

Bankruptcy is really not a do it yourself project, except possibly for people who have a friend who is a lawyer who coaches them. You really need counsel, and to get a case done in time, you need to retain counsel literally in the next day or two.
It is possible, and highly NOT recommended, to do skeletal filings. Bear in mind you must electronicaly file, which bankruptcy lawyers can do. Since you would lack the software, you'd have to manually scan it at the court.
Our fees for Chapter 7 are very reasonable, and wed have a handful of open appointments this weekend. If we can assist you and you're sin metro Atlanta, get one of our packets at www.glenashman.com and call us for an appointment at 404-768-3509. You'll find info on our fees in that packet.
