Legal Question in Bankruptcy in Georgia

judgement vs bankruptcy

I was awarded a judgement in 2006

against a former tenant and filed a

fifa while I located her place of

employment.After contacting her

(nice guy eh) and deciding on going

further with a garnishment, she said

that she was at a good place

financially and would rather enter in

some kind of installment

arrangement. I put together an

installment plan with her employer

as an intermediary, and yesterday,

received notice that she had filed

chapter 7. How does that effect my

judgement aginst her for $1400 plus

and what rights do I have in ever

seeing this debt attempted to be

reconciled. If not now, does ga. law

permit it to be resurrected some time

in the future

Re: judgement vs bankruptcy

Generally, unsecured creditors will file a claim with the clerk and hope for some recovery. In most cases, that will be little or nothing, and the debtor will geta discharge of the debt. You are barred by law from even contacting the debtor about this debt. Make sure you file a proof of claim by any deadlines.
