Legal Question in Bankruptcy in Georgia
money owed from company that went bankrupt, is new company responsible?
I pre paid for a certain number of visits to a company (company A) that has recently gone out of business. The new company (company B) that ''took over'' Company A's business/clients, is saying that since company A filed bankruptcy, Company B is not responsible for A's debt. They will exchange services, but will not refund my money. I just want what I paid for, or my money back. I don't want other services. Is there any legal action that can be taken against the company, or is it true that they are not responsible? This all happened in Febuary 2009, and since then, they have been giving me that run around, telling me that they will offer that service again in a few weeks. But they say that every time. And now, they are saying that they are not going to offer that service.

The obligations of the new company are based on the documents, contracts, the specific nature of the transactions, etc. - none of which are discussed or identified in your post. "Took over" does not tell us what happened.

As a general rule Company B would not have any liability, but that depends on information you did not post (including a copy of the paperwork showing how they "took over" the business).
