Legal Question in Bankruptcy in Georgia
Hello. I stay in ga. I am considering bankruptcy (chapter 7 or 13). I am unemployed but I recieve child support. I have no assets, i dont own a car and my 2 kids and I are now staying with my parents. My student loans are in default, I have been served summons for 2 defaulted credit cards, I start paying a settlement for another card..plus I have a few store credit cards( I buy my kids school clothes with) which are not in default.
Do I have a good bankruptcy case. I know a job will help, but I go searching for a job everday and havent find anything yet. I babysit sometimes but that go towards other expenses. Ive tried talking to the creditors they want the full settlement?

Even though you need to sit down with a local attorney, the information you gave makes it sound like you are an excellent candidate for Chapter 7. Do not start paying that credit card before you see a lawyer as that payment may be wasting money.
A Chapter 7 would eliminate all the credit cards and judgments. You would also get about 4 months of quiet from the student loan people, and could use that time to work out forebearance or delay in payments.
It is far easier to file when you are not working than working. Good luck.
I agree with Mr. Ashman, based on the limited information, it appears that you would be a candidate for a Chapter 7. Go see a bankruptcy lawyer in your area as soon as can.
