Legal Question in Bankruptcy in Georgia

Switching from Chap. 13 to Chap 7.

We filed BK in 2004 and were dismissed in 9/04. We are currently under a Chap 13 and finding it difficult to pay the trustee and pay the household bills. Can you switch from a Chap 13 to a Chap 7?

That is a question for your lawyer, who knows the facts of your case and can determine whether or not you even qualify for a Chapter 7.

You probably can, but only your Chap. 13 attorney is equipped to know for sure. Check with him. It is part of what you paid him for.
