Legal Question in Business Law in Georgia
Business name
My partner and I are starting a new company, the business name we selected is currently being used by a company in New York, but the type of business we are in is totally different from that company. Is it legal to have the same business name? We are an investigative firm, and they appear to be an IT company that provides database software development.

You probably will want to change the name slightly or put something regarding the type of busiuness in your name that would differentiate from the New York company. Chances are there is nothing that wuold come about it but if they ever expand thay may consider it a trademark infringement.
