Commission Payments Delayed and then paid incorrectly
I am a manager of commission based employees as well as a commssioned based employee myself. Our company was recently purchased in late 2006 and officially transitioned to the new company's payroll on 4/1/2007. We are paid a monthly commission ( a multiplier based on a target commssion divided by quota). We have been paid a commission for each month, but it is not based on actual results. They were to reconcile the Apr-Jun commission against actuals and pay these in July. We received a payment, but it was incorrect. We have not been given a check stub for these reconciliation payments or a commission statement show how the actual result payment was reconciled against the commission payments we previously received. I would like to know if I have a legal case to demand the commission statements so that I can audit reconcile the payments against the actuals and also demand the payment of the difference?

It may well be that you have a case if you can prove what you said in your post. Consult with a local attorney to review the whole situation.
