Legal Question in Business Law in Georgia

No Compete Clause

I had worked for a company doing phone sales. Left the company and ended up working for one of their clients that I had worked a project for. Somehow they found out and said I am in breach. The guy I now work for took the clause out of his contract unbenounced to them and they accepted it. Unfortunately I didnt do the same. What can they take me to court for?And how can they prove the scope of what I am doing in work to claim it as compteing?

Re: No Compete Clause

Covenants not to compete are tricky to enforce in Georgia, but they can be enforced. A company could go to court and obtain an injunction preventing you from working at your new compnay. Unfortunately, there is no way to give you any advice regarding your current situation without reading the agreement and learning more about your duties at your former and current jobs. You will need to meet with an attorney about this matter. Of course, I will be happy to help you if I can, but I urge you to find and work with an attorney who knows the ins and outs of non-competes.

It is impossible to determine your rights vs the company's without reviewing your contract. Consult with a local attorney.
