Contract

My mother is an insurance agent working as a contract agent for a large insurance agency for the past 5 years. The agency was sold recently, and she was asked to sign a contract with the new owner. The contract binds her not to work in the insurance business for 2 years if she leaves. She refused to sign the contract and was fired. She is owed money for previous business written. Can her boss hold her check because she refused to sign the contract? She never agreed verbally or in writing to a contract.

The short answer: the company owes the agent for commissions earned. The agent is not required to execute the non-compete to receive her pay.

There is no way to answer with anything but a guess, because we do not know the terms of her employment up to the time she was terminated, and the terms under shich she would be paid commissions.
