DayCare closes Owes me money

My son recently attended a day care that has closed. The owner of the daycare owes me money that I paid in advance for care. It has been two and a half months since the closing and I still haven't gotten my money. What course of action do I have against her? Is she legally bound to pay me the money she owes? How do I go about collecting?

An action in magistrate's court may be available to you, as long as the amount of money that you are owed does not exceed the limit of the court's authority.

Probably the daycare owes you the money, whether that is the owner individually or a company depends on the contract. Either way you would need to sue whoever owes you the money, which can be done in magistrate (small claims) court as long as your total damages sought do not exceed $15,000.00.
