i am a building contractor and own 40% of my business. i won a judgement against a man I built an office suite for, who did not want to pay. i am now getting a divorce and my wife says she should get half of my portion (40%) of that judgement. she is not a stockholder in my company and i fully intend to take care of her and my children. Is she entitles to any part of that judgement?

She may well be entitled to something, but that needs to be investigated in terms of the big picture of your and her financial positions. Contact a local attorney for a consultation.

Your soon to be ex-spouse is entitled to that property, alimony and child support as you agree in the negotiated final settlement. Whether she becomes a partial owner of your company and therefore entitled to a portion of the judgement proceeds depends on your settlement with her. In all cases, the court is concerned with the welfare of the parties in the following order: 1) the children 2)the custodial parent (usually the wife) 3) the non-custodial parent (usually the husband).
