Legal Question in Business Law in Georgia
Is there Fraud or breach of contract?
My grandparents paid a small company to cut and remove trees from their yard. After cutting the trees, they failed to remove them. That was two weeks ago. There are still six trees laying in the yard. All efforts to contact the company have failed, and I cannot find an address to mail a notice that legal action is being taken. What steps should be taken to file suit, and how do we find them to accomplish this?

Fraud or Breach of Contract
It appears that your grandparents have been victimized by unscrupulous migrant service workers. They usually drive up in a truck, give the homeowner a bid, do the work and then demand payment saying they will be back tomorrow to finish the job. Your parents are lucky the trees were cut down. In order to track these people down it would require a private investigator. If you did find them you have the probability that they have no assets that could be taken as satisfaction for the judgement except their truck which would probably be exempt from seizure since it is required for the tree trimmers livelyhood. This is the situation where the legal remedies would cost more than hireing someone to remove the downed trees. Unfortunately older people are victimized by these slezzy operators. The best advice you could give older people is not to deal with anyone just happens to be in the neighborhood. Next to telephone fraud on older people, this type of fraudulent service is the worst racket perpertrated on the elderly. I wish I could offer more encouragement.
