Legal Question in Business Law in Georgia

Am freelance court reporter working mainly for one agency on 75/25 split.Discovered that owner of agency has been using client payments for her own personal expenses rather than paying me. Currently owes me approx. $40K. Have her admission and promise to pay in writing but no plan or timetable for repayment. Claims to have no cash assets, but she owns substantial unencumbered real estate. What are my options?

If you're a court reporter, then you're probably well versed with the importance of seeking legal counsel in this situation, and it would be wise to do so sooner rather than later.

Potential options could range from suing the agency and its owner for breach of contract and fraud, to perhaps entering into a formalized and enforceable agreement with the agency/owner.

There is nothing in your post to indicate you have a claim for fraud, as opposed to a contract claim for money due for your services. You certainly don't want to even make allegations like that without a basis as it is not likely to help resolve the issue. Since you may have run across some lawyers you feel comfortable with, give one a call to discuss or ask them for a referral.
