Legal Question in Business Law in Georgia
A friend of mine has been granted an exclusive license from a government agency to market a particular product. The government agency has had a long standing prohibition in disallowing the placement of advertising materials on certain receptacles found at most residences in the U.S. While the government agency has not enforced the improper placement of these materials, the fact remains it "illegal" to do so. Can my friend issue a cease and desist letter to the companies marketing the advertising products and/or demand a percentage of gross sales from these companies dating back to my friend's acquisition of the exclusive licensing agreement?
