Legal Question in Business Law in Georgia

Limousine Service Sub-Contractor

If you assign a sub-contractor(Driver) several limo runs and he fails to do them after accepting them in turn costing the company money and customers, can he/she be held accountable via the law? The amount that he cost me with his ''problems'' is over 2000.00 dollars and several customers that will never use us again and they have been with us for years. This driver was given chance after chance to perform correctly and still failed to do so. We parted ways and now he wants back pay which I can not give to him due to the amount of lost earnings and slow business from the economy being rough. Any help would be appreciated. Thanks.

Re: Limousine Service Sub-Contractor

Certainly, if your sub has breached his agreement with you, you would most likely be entitled to your proximate damages. However, if a written agreement was in place, verify that it does not limit his liability or damages.
