Legal Question in Business Law in Georgia
I needed to ask a question on disorderly conduct. One of my closest who went to buy a car had a miscommunication with one of the car sales representatives. There was no violence involved at all, All she did was grab the contract off his desk and tear it up, due to the fact that she didnt want to purchase the car and the rep. refused to let her reexamine the contract. Keep in mind that my friend does speak english but very little. After that she did apologize for her actions but the rep. threaten to called the police- The rep. told her that she had to buy the car or the would call the police. In this case if they were to call the police what would the penalties be against her?

As a Franchise Attorney I can say the following. The police will not get involved in a civil dispute over a car. Their threat is an idle one. Consult with a good business or franchise attorney in your area for specific advice.

The police are not likely to jump into a civil dispute with a shyster car dealership that would threaten a customer that way, and after leaving she needs to report the dealer to the Better Business Bureau and state Office of Consumer Affairs. As long as she walked out and didn't stay and cause a scene, it is unlikely she would have a problem. Note that if she stayed and got boisterous, the answer would change and she could face a year in jail and a $1000 fine.
(Note that once she signed there IS a legal contract that can be enforced, and tearing it up does not change that, so the question you didn't ask is the one that actually matters).
