Overpayment to a vendor
my company is a trucking business. we gave an advance to a sub-contracted trucking company for a load they hauled for us. they billed us for the entire balance without deducting the advance and we erroneously paid the full amount. what is the law on this to recoup the funds $500. thanks

Usually, I would recommend a demand letter from an attorney if they will not pay back the money, and then possibly a law suit. However, because of the small amount owed, it may not be worth it to pay an attorney to handle it. Filing in magistrate (small claims) court is an option, but it will take time. A threat to do no future business with them may be the most economical option.

Courts are there to correct mistakes. Actually, court may be avoided entirely. If it comes to that, this sounds like a Small Claims (Magistrate Court) case to me. If you would like, feel free to give me a call. I can walk you through the procedure.
