Legal Question in Business Law in Georgia

Ownership

We sold our house to the state DOT due to road construction (right of wy came to our front step) coming too close for us to remain in the dwelling. We did not sell any land to the DOT. Do we still own the land that the house sat on or does the DOT own it?

Re: Ownership

Read your documents or have a lawyer review them. No one here has them, and you do not tells us what they say. These are issues that should have been understood prior to selling anything.

Re: Ownership

It depends on the wording of whatever you signed in favor of the DOT. Have them reviewed by an attorney.

Re: Ownership

It depends on exactly what you "sold".

If the DOT condemned the entire parcel, they own it all.

If, however, they condemned only the right of way and the right to demolish the house, you still own the remainder of the property.

Determining this will require examination and interpretation of the papers you signed for the DOT, and possibly your original deed. You should refer this to an attorney.
